Introduction, Application & Definitions

1. Application Of This Policy

This Acceptable Use Policy ("AUP") governs the use of all Services supplied by Wicked Web Wizard (Pty) Ltd ("Wicked Web Wizard").

This Policy applies to:

  • Website Hosting;
  • Domain Services;
  • Email Services;
  • SaaS Platforms;
  • FarmServ;
  • Client Portals;
  • Websites;
  • Applications;
  • APIs;
  • Technical Services;
  • Future Services provided by Wicked Web Wizard.

This Policy forms part of:

  • The General Terms & Conditions;
  • Hosting & Domain Terms;
  • SaaS Terms;
  • Website Development Terms;
  • Any Service Agreement.

2. Purpose Of This Policy

The purpose of this Policy is to:

  • Protect infrastructure;
  • Protect users;
  • Protect clients;
  • Protect Wicked Web Wizard;
  • Ensure lawful use of Services.

3. Client Responsibility

Clients remain responsible for all activity occurring through:

  • Their accounts;
  • Their websites;
  • Their domains;
  • Their applications;
  • Their users;
  • Their employees;
  • Their contractors.

Clients shall take reasonable steps to prevent misuse of Services.

4. Interpretation

Any capitalised term shall have the meaning assigned in the applicable Service Agreement or General Terms & Conditions.

5. Right Of Enforcement

Wicked Web Wizard reserves the right to investigate, restrict, suspend or terminate Services where this Policy is breached.

Wicked Web Wizard may act without prior notice where immediate action is reasonably necessary.

Prohibited Activities

6. General Prohibition

Services may not be used for any unlawful, abusive, harmful or fraudulent purpose.

Any activity creating unreasonable risk to Wicked Web Wizard, its infrastructure, clients or third parties is prohibited.

7. Fraud

Clients shall not utilise Services for:

  • Fraud;
  • Misrepresentation;
  • Deceptive conduct;
  • Identity theft;
  • Financial scams.

8. Phishing

Phishing activities are strictly prohibited.

This includes:

  • Credential harvesting;
  • Fake login pages;
  • Account impersonation;
  • Fraudulent communications.

9. Malware

Clients shall not create, host, distribute or facilitate:

  • Malware;
  • Viruses;
  • Trojans;
  • Worms;
  • Spyware;
  • Ransomware.

10. Unauthorised Access

Clients shall not:

  • Attempt unauthorised access;
  • Circumvent security;
  • Escalate privileges;
  • Access systems without authority.

11. Network Abuse

Clients shall not engage in:

  • Port scanning;
  • Vulnerability scanning;
  • Network probing;
  • Packet interception;
  • Traffic manipulation.

12. Denial Of Service Activities

Clients shall not participate in:

  • DoS attacks;
  • DDoS attacks;
  • Traffic flooding;
  • Network disruption.

13. Botnets

Operation of botnets or command-and-control systems is prohibited.

14. Spam

Unsolicited bulk communications are prohibited.

This includes:

  • Email spam;
  • SMS spam;
  • Automated messaging abuse.

15. Blacklisting

Clients shall not engage in conduct likely to result in:

  • IP blacklisting;
  • Domain blacklisting;
  • Mail server blacklisting.

16. Copyright Infringement

Clients shall not host or distribute material infringing:

  • Copyright;
  • Trademarks;
  • Patents;
  • Intellectual Property Rights.

17. Unlawful Content

Clients shall not host, distribute or publish content that is unlawful under applicable law.

Resource Abuse & Infrastructure Protection

18. Excessive Resource Consumption

Clients shall not utilise Services in a manner that:

  • Degrades performance;
  • Impacts other users;
  • Creates instability.

19. Cryptocurrency Mining

Cryptocurrency mining is prohibited unless expressly authorised in writing.

20. Streaming Services

Hosting Services may not be used for large-scale streaming without prior approval.

21. File Storage Abuse

Services may not be used primarily as:

  • File repositories;
  • Backup repositories;
  • Archival storage systems.

22. Automated Abuse

Clients shall not deploy automated processes creating unreasonable load.

23. Right To Restrict

Wicked Web Wizard may throttle, suspend or restrict Services to protect infrastructure.

Content Standards & Prohibited Content

24. General Content Obligations

Clients shall ensure that all content hosted, transmitted, stored, published or distributed through the Services complies with:

  • Applicable laws;
  • Regulatory requirements;
  • Third-party rights;
  • This Policy.

Clients remain solely responsible for all content associated with their Services.

25. Illegal Content

Clients shall not host, distribute, publish, transmit or facilitate unlawful content.

Wicked Web Wizard may remove unlawful content immediately upon discovery.

26. Fraudulent Content

Clients shall not publish content intended to:

  • Mislead users;
  • Defraud users;
  • Obtain information deceptively;
  • Facilitate criminal activity.

27. Defamatory Content

Clients shall not knowingly publish unlawful defamatory content.

Wicked Web Wizard may restrict or remove disputed content where legal risk exists.

28. Hateful Content

Clients shall not publish content that unlawfully promotes:

  • Violence;
  • Criminal conduct;
  • Hate crimes;
  • Unlawful discrimination.

29. Harassment

Services may not be used to harass, intimidate, threaten or abuse individuals or organisations.

30. Threats

Content containing credible threats of violence, criminal conduct or unlawful activity is prohibited.

31. Child Exploitation Material

Any content involving child exploitation, abuse or unlawful activity relating to minors is strictly prohibited.

Discovery of such material may result in:

  • Immediate suspension;
  • Immediate termination;
  • Preservation of evidence;
  • Notification of authorities.

32. Human Trafficking

Services may not be used to facilitate human trafficking, exploitation or related unlawful activities.

33. Terrorism

Services may not be used to support, facilitate or promote terrorism or terrorist activities.

34. Weapons Trafficking

Services may not be used to facilitate unlawful weapons trafficking or related criminal activities.

35. Drug Trafficking

Services may not be used to facilitate unlawful drug manufacturing, trafficking or distribution.

36. Obscene Material

Wicked Web Wizard reserves the right to restrict or prohibit obscene content where such content creates legal, operational or reputational risk.

37. Adult Content

Adult content may be prohibited at Wicked Web Wizard's sole discretion.

Where permitted, such content shall comply with all applicable laws.

38. Misleading Content

Clients shall not publish content that falsely represents:

  • Identity;
  • Ownership;
  • Authority;
  • Credentials.

39. Intellectual Property Violations

Clients shall not publish content that infringes:

  • Copyright;
  • Trademarks;
  • Patents;
  • Design Rights;
  • Intellectual Property Rights.

40. Content Removal

Wicked Web Wizard may remove, disable or restrict content where it reasonably believes:

  • This Policy is being breached;
  • Legal risk exists;
  • Security risk exists;
  • Infrastructure risk exists.

No prior notice shall be required where immediate action is necessary.

41. No Liability For Content Removal

Wicked Web Wizard shall not be liable for losses arising from content removal undertaken in good faith.

Abuse Complaints, Investigations & Compliance

42. Abuse Reports

Wicked Web Wizard may receive complaints from:

  • Clients;
  • Registrars;
  • Registries;
  • Rights Holders;
  • Law Enforcement Agencies;
  • Regulatory Authorities;
  • Third-Party Providers.

43. Investigation Rights

Wicked Web Wizard may investigate any alleged breach of this Policy.

Investigations may include:

  • Log Reviews;
  • Traffic Analysis;
  • File Inspections;
  • Security Reviews;
  • Email Reviews.

44. Client Cooperation

Clients shall cooperate with reasonable investigations.

Failure to cooperate may constitute a material breach.

45. Preservation Of Evidence

Wicked Web Wizard may preserve:

  • Logs;
  • Files;
  • Emails;
  • Audit Records;
  • Account Records.

Such records may be used for:

  • Investigations;
  • Legal Proceedings;
  • Regulatory Compliance.

46. Copyright Complaints

Wicked Web Wizard may remove content upon receipt of a copyright complaint.

Wicked Web Wizard shall not be required to determine ownership before taking protective action.

47. Security Complaints

Security-related complaints may result in immediate suspension pending investigation.

48. Law Enforcement Requests

Wicked Web Wizard may comply with lawful requests from:

  • Courts;
  • Law Enforcement Agencies;
  • Regulators;
  • Government Authorities.

49. Regulatory Compliance

Clients remain responsible for compliance with laws applicable to their activities.

50. High-Risk Accounts

Wicked Web Wizard may designate accounts as high-risk.

Additional restrictions may be imposed on high-risk accounts.

51. Cost Recovery

Where abuse investigations arise from Client conduct, Wicked Web Wizard may recover:

  • Administrative Costs;
  • Technical Costs;
  • Legal Costs;
  • Third-Party Costs.

Enforcement, Suspension & Termination

52. Right To Enforce

Wicked Web Wizard may take any action reasonably necessary to enforce this Policy.

53. Immediate Suspension

Services may be suspended immediately where:

  • Serious Abuse Occurs;
  • Security Risks Exist;
  • Legal Risks Exist;
  • Infrastructure Risks Exist.

54. Restrictions

Wicked Web Wizard may:

  • Restrict Access;
  • Remove Content;
  • Disable Services;
  • Block Communications.

55. Termination

Wicked Web Wizard may terminate Services where:

  • Serious Breaches Occur;
  • Repeated Breaches Occur;
  • Continued Provision Creates Risk.

56. No Refunds

No refund shall be due where Services are suspended or terminated due to breach of this Policy.

57. No Liability

Wicked Web Wizard shall not be liable for losses arising from enforcement actions undertaken in good faith.

58. Repeat Offenders

Repeated violations may result in permanent termination.

59. Future Services

Wicked Web Wizard may refuse future Services to persons who repeatedly violate this Policy.
